The Truth About The Constitutional Right To Bail

Over recent months, the law relating to bail in Uganda has been one of those that are catching the interest of the Ugandans. Many Ugandans today are uncertain of what entails bail thus many have been made to either think bail is a mandatory reward by the court upon application or to the contrary; however, many have been surprised to find it otherwise.

In this article, we shall dig deeper into this legal term/concept by looking at its meaning, applicability, access or denial, and any things incidental or consequential to this right.

Bail can be defined as an agreement between the court, accused and sureties, on the other hand, the accused will attend his trial in a manner agreed upon without fail unless agreement to the contrary.

It is important to note that Bail is applied for by the criminal suspects thus plausible to say only people accused of committing cases of criminal nature and are in custody are the ones that apply for bail.

It is governed by two principles that determine its grant/denial by the court. Firstly, the accused is presumed to be innocent until proven guilty or until he/she pleads guilty, making it unfair in certain circumstances to keep that person in prison. This principle roots in article 28(3) of our 1995 constitution.

Secondly, a person may be given bail when he/she is the only one capable of building his defense at trial. Thus, bail is given to enable the accused to defend himself properly. Before the accused person is released, it must be understood that he will be returning for trial till the completion of the trial.

Bail is the right of the accused to apply to the court for a conditional release. It is crucial to appreciate that conditions are attached to the bail. The right of the accused to apply for bail is provided for under article 23(6)(a) of the constitution of the republic of Uganda 1995 as amended, which provides that where a person is arrested in respect of a criminal offense, is entitled to apply to the court to be released on bail, and the court may grant that bail on such conditions as it sees reasonable.

Ugandan courts have been empowered to grant bail to the applicants on terms considered in the view of the court are reasonable. The magistrates’ courts under section 75(1) of magistrates courts Act Cap 16 are allowed to grant bail to persons with offenses triable by the high court, offenses of terrorism, cattle rustling, abuse of office, embezzlement, corruption, and others as provided for under section 75(2) of the Magistrates courts Act Cap 16.

Equally, the high court may, at some stage in the proceedings, release the accused person on bail upon he /she paying the fees demanded by the court under section 14 of the Trial on indictments Act.

The spirit of paying fees to court before granting a person bail is in good faith- to act as one of the guarantees that the accused will come back to court, not disappear, causing a miscarriage of justice. Regard has to be made to the laws above, in which the word “may” implies that granting bail is at the court’s discretion.

For any person to be granted bail, he or she must present sureties. These are people that the accused presents to assure the court that the accused will show up for a trial or, in case the accused disappears, the court will resort to the sureties asking them to present or help the court bring the accused person for trial. This, therefore, has a legal effect to the extent that both the accused and the sureties pay a prescribed amount of money to the court. In court language, this money is called recognizances.

However, the court has the power to charge any amount of money on the accused, this money must be reasonable depending on the offense committed. This operates to prevent excessive charges that would prevent the accused from accessing their right to bail.

The high court is further empowered under section 75 of the magistrate’s courts Act to interfere with this discretion of the lower court if it can be shown that the money was not charged judiciously.

Therefore, courts should impose high monies and conditions to the accused before granting bail concerning the gravity of the offense alleged to have been committed.

In the case of Charles Onyango Obbo and Andrew Mwenda V Uganda (1997)3 KALR, the high court intervened in this matter upon the application by the accused on the grounds of excessive bail money that had been imposed on them. The high court reinstated the money and stated that the condition that each accused should pay UGX 2M was a failure by the lower court to judiciously exercise its desecration.

What are the considerations for bail?

There are several factors courts will consider in granting or denying bail since bail isn’t automatic. The conditions are codified in the trial on indictments Act and the Magistrates Courts Act.

Before a magistrate court, the court relying on section 77 of the Magistrates courts, looks at the nature of the accusation, the gravity of the offense being charged, the severity of the punishment, the antecedents of the applicant, whether the applicant has a fixed abode within courts jurisdiction and whether the applicant is likely to interfere with any of the witnesses of the prosecution.

Courts consider those facts before granting bail under the magistrate’s courts Act Cap 16.

In the high court, however, the court demands the applicant to prove that the exceptional circumstances exist justifying his/her release on bail, that he or she will not abscond when released on bail, grave illness certified by a medical doctor, certificate of no objection signed by the DDP, the infancy or the advanced age of the accused, whether the accused has fixed abode within the jurisdiction of the court and whether the accused has sound sureties within the jurisdiction of the court.

Any person applying for bail before the magistrate or high court must prove those elements. If he or she fails to do so, the court may do away with granting bail.

Another significant aspect of addressing is whether bail is a constitutional right and, therefore, automatic. In the foregoing discussions, I have already hinted that bail is a non-automatic right. However, I intend to throw more vivid light to clarify.

Generally, the grant of bail is discretionary; courts always exercise their powers discretionary and judiciously in granting this bail. Thus, before some courts, people may demand to prove all factors or give the accused a benefit of the doubt in case of failure to prove some factors.

Furthermore, the right to bail is a constitutional right and enjoys constitutional protection because of the protection of personal liberty based on the presumption of innocence.

Thus any applicant to bail cannot be deprived of his or her right unreasonably, bail cannot be refused merely as a punishment as this would conflict with the presumption of innocence, any refusal to grant bail cannot be based on mere allegations, and both High court and subordinate courts have discretionary powers to set bail conditions which they deem reasonable though this must be done with caution.

In the case of Uganda V Col. (RTD) Kizza Besigye, constitutional reference no. 20 of 2005, the constitutional court, while granting bail to the accused, held that the applicant should not be deprived of his /her freedom unreasonably, and bail should not be refused merely as a punishment as this would conflict with the presumption of innocence. The refusal to grant bail should not be based on mere allegations. The grounds must be substantiated. Both the high and subordinate courts have discretionary powers to set bail conditions that they deem reasonable, though this must be done with caution.

In conclusion, it is essential to make it clear that every accused person has a right to apply for bail; however, the court has the discretion to either give the accused bail or deny it. Hence, it’s safe to conclude that bail is a constitutional right that is not automatic; the accused, while applying for bail, should bare in mind that it remains at the discretion of the court to grant the bail or not.

Buganda Road Court has this afternoon granted bail to the nine students of Makerere and Kyambogo University who last week took to the streets to peacefully march to the EU headquarters to deliver a petition supporting the ban on the East African Crude Oil Pipeline project.

The students were however intercepted by police officers from the Field Force Unit, violently arrested and prosecuted in court before eventually getting remanded to Luzira prison till today. An EU directive challenging the arrest of the students was disregarded by the Ugandan government.

In today’s session, NUP lawyer Shamim Malende was substituted for Eron Kiiza, following a protest by Dr. Stella Nyanzi who claimed the celebrated NUP attorney was squarely to blame for the remand of the students amongst whom contained her lover, Musiri David, the head of the NUP party institutions wing.

Court today resumed with Eron Kiiza in session. It was adjourned for an hour from 10am to 11am to enable the counsel to arrange his substantial sureties for the nine students grappling with charges of public nuisance. The students have been successfully bailed out on cash worth UGX 100,000 for each of them. The widely condemned detention of students was justified by the Kampala Metropolitan Police Spokesperson Patrick Onyango who said it was necessary as they never sought permission to hold the protest. Onyango went on to accuse the student protesters with having allegedly been hired and paid by external and political actors opposed to EACOP.

Police have this morning swung into action and descended on a group of students opposed to the East African Crude Oil Pipeline project. Unlike previously when protesters in support of the Pipeline were guaranteed police protection, the group that is opposed has been brutally beaten by police from CPS Kampala.

The students mainly from Makerere and Kyambogo universities were intercepted a few metres away from the European Union head offices in Kololo, Kampala. They had a petition with them detailing why they support the EU parliament resolution halting the project.

Stingy Bobi Wine Gifts His Compatriot Joel Senyonyi 10K

The tightfistedness of Bobi Wine has been talked about by his mates but it had not been witnessed barely until he gifted his compatriot Joel Senyonyi with Shs. 10,000 Ugx.

The National Unity Platform (NUP) president, Robert Kyagulanyi has given Nakawa West member of parliament Joel Senyonyi only 10,000 Uganda shillings for his commendable job of unmasking the dirty deeds of some government officials.

Joel Senyonyi, the former news anchor at NTV Uganda was given the mantle to chair the Committee on Commission Statutory Authorities and State Enterprises (COSASE) meetings in the parliament of Uganda.

The NUP spokesman has done the job tremendously well and has exposed the incompetence of those who manage most government enterprises. The enterprises that have fallen to his weld are the Uganda Railways Corporation and Uganda Airlines.

The case that has raised eyebrows is that of Uganda Airlines where its top brass Bamutalaki has been exposed plain clean for being corrupt and unqualified for the job. Based on this matter Robert Kyagulanyi decided to reward his compatriot Joel Senyonyi with 10K.

The former presidential candidate 2021 went to Twitter to express how proud he was of Joel Senyonyi for exposing the incompetent government officials and asked anyone near the hard-lining COSASE chairman to give him 10,000 UGX which he will pay back later.

Barbie Kyagulanyi, Bobi wine’s wife took on the responsible and sent 10K Senyonyi through mobile money. Today morning, the former news anchor acknowledged receipt of the money and thanked his principal for his generosity.

Considering Kyagulanyi’s stature, offering someone 10K as a reward is a stingy gesture. He should have done better than giving out such a small quid which cannot even buy a kilo of meat in Uganda.

Police Issues Guidelines for Nyenge Nyege Festival

The Uganda Police and other Security Agencies have issued guidelines to be followed for those who will attending the Nyege-Nyege Festival starting on Thursday 15th – 18th of September, 2022 in Njeru, Jinja city.

Uganda Police Spokesperson Fred Enanga, said since it is the first of its kind after Covid-19, it is expected to attract between 15, 000- 20, 000 celebrators, fans and goers who will enjoy the live music shows, parties and celebrations.

Therefore, the Joint Security Agencies has called upon all those intending participants to enjoy the festivity in a safe, responsible and respectful manner for themselves, and the people in the local area.

“We are, however, prepared to counter all forms of threats and to tackle any other vulnerabilities or eventualities targeting revelers. We have also reviewed the safety management plan of the organizers and the proprietors, their response plans, security and staffing levels, traffic controls, access controls, emergency evacuation plans and the deployment of specialized equipment,” Enanga said.

The Joint Security Teams will have a robust presence on site and will firmly deal with any crime, during the possession or any anti-social behaviors, he added.

“We have deployed within the venue spaces personnel who will be on the lookout for disruptive and potentially predatory behaviors. They will coordinate with the CCTV operating center.”

Mr Enanga also added, the behaviors include loitering, leering or intoxicated individuals, harassment of female especially young female adults, committing acts of sexual violence, physical assaults, robberies and thefts, will always be looked through.

The vast majority of people who want to have a good time are reminded to keep an eye on what and how much they drink.

Revelers are warned to be cautious with their properties like bags and mobile phones not to leave them unattended. Continually, the Police has urged people not to bring unnecessary bags to the event.

Those who will attend are encouraged to keep valuables closer at all times and also cautioned to keep wallets and purses out of sight.

Since the Joint Security Agencies anticipates predatory behavior from sex predators, targeting young adults and women. Revelers are advised to look out for potential sex predators spotting and stalking them. “We shall be on the lookout,” Said Enanga

Celebrators are also advised not to enter any camping site or tent without their will.

“Avoid any compromising situations like lone movements, especially at night. Entering a tent can easily lead to acts of victimization including sexual violence.”

“Notify medics and police in case a health concern arises. While at the venue, revelers should make sure they are aware of the surroundings. They should report any suspicious object or persons to the police or the organizers,” he said.

Attendants should pay much attention to where they can exit from the venue and have a plan in case they need to leave quickly. Also, Police have cautioned that the open waters of the River Nile will not be available for swimming.

Attendees must also ensure their camp or tent is not left unsupervised. While those buying a ticket, have been advised to ensure that they are purchased directly from the event organizers.

Victims of sexual abuse or violence are encouraged to immediately report to the police for investigations and post-rape treatment.

“Everyone should be able to enjoy the festival safely. We are focused on spotting disruptive behaviors, detecting and preventing many other kinds of crime, and remain dedicated to doing all within our means to keep the venue safe and secure for everyone,” said Enanga.

Meanwhile, Nyege Nyege is a festival that promotes foreign music, primarily electronic, by African artists. It was founded in 2013 by ex-pats Arlen Dilsizian and Derek Debru. It’s a multi-day annual festival that refers to a Luganda word Kinyegenyege describing “a sudden, uncontrollable urge to dance” .

Police Link Sipapa’s Fingerprints & DNA to Other 12 Crime Scenes

Police forensic experts have linked fingerprints of the famous also called Sipapa to other 12 crime scenes done in areas around Kampala metropolitan.

According to the police spokesperson Fred Enanga, the crimes date back from 2014 to date. These crimes are done mostly in areas of Bugolobi, Kampala city, Kira road, Jinja road, Kiwatule, Ntinda, Kyanja and Jomayi.

Last week Sipapa was charged by the Magistrate court of Makindye for aggravated robbery together with the wife and the other group, and there were remanded to Luzira prison.

“According to the fingerprints and DNA samples we were left with from Charles Olimu (Sipapa), we are linking him to 12 other scenes of crime of burglary and theft,” said Enanga.

Our directorate of CID in close coordination with the directorate of forensics has now established 12 other cases that are linked to Sipapa. His DNA and fingerprints were scientifically matched with the 12 other scenes, implying he was a perpetrator at the scene of all the criminal incidents in Kampala, Enanga said.

The task teams are arranging to interrogate him on the string of alleged burglaries and theft.

Sipapa was arrested following the alleged theft of the South Sudan citizen’s money and other properties. Uganda’s Music Industry is Full of Witch Craft – Recho Rey

Uganda female rapper Recho Rey alleges that the music industry is full of witchcraft. The hip-pop artist burst onto the scene in 2018 when she redid the famous “Who is Who” riddim that most rappers in the country jumped on to show their prowess in the game.

She adjusted to another style of music after capturing public interest. She did a couple of good songs including Seka Seka, Kiba Kigwa, and Olimba that hit the airwaves for some time until she went into a slumber which she has recovered from.

She has been trying to do some songs here and there ever since she parted ways with her first management in 2020 but all have not even churned out of the studios they have been recorded from.

Recently, she came out to claim that the music industry is characterized by voodoo which has left most talents going to waste.

This is what she exactly alleged during an interview, “The industry is full of witchcraft. Some musicians do Voodoo to keep trending”.

“The Black girl fly” is not the first to make such allegations, other musicians like Nince Henry and Red Banton came out in the past to claim the same. Red Banton went further to sing about the witchcraft eating up the industry in his song “Baloogo”

Gen Nalweyiso Makes an Account of Sipapa’s Crimes

After the arrest of Kampala’s most famous criminal cum Socialite Sipapa, Lt Gen Proscovia Nalweyiso applauded the tremendous work done by the police. She said that it was high time they went into action to put an end to Sipapa’s insolent behavior.

“Sipapa is a thief. What’s worse, he uses the NRM association to commit crimes. President Museveni shouldn’t tolerate such characters,” Nalweyiso said in an interview.

“I have been trailing him for some time. He has a group of over 30 people who go to people’s homes to steal valuables, like laptops, and screens.

I am among the people who worked hard to ensure his security is withdrawn. How can a thug have security,” the top-ranking army officer said.

Sipapa is apparently in jail for allegedly robbing $ 42,000 from a South Sudanese national.

Early last week, a South Sudanese who was identified as an army officer in the Sudanese army reported to Kabalagala police station for being robbed of $ 42,000 equivalent to Shs.1.6 billion.

The police swiftly carried out the investigations that led them to Sipapa’s home where some of the stolen items were found, part of the cash, iPhones, and a laptop.

Sipapa’s wife was arrested and later on the husband handed himself over to the authorities. In mid-week, the pair appeared at Makindye civil court where they were read their crimes and remanded to Luzira Prison.

It is alleged that 12 more crimes have been added to Sipapa’s case and he will later be presented in court this month.

Rema Namakula Lauds Winnie Nwagi

Over the weekend, Winnie Nwagi alias Fire baby made a milestone when she became the first artist to fill up Lugogo Cricket Oval to full capacity in her maiden concert.

Loads of people were in attendance including fellow musicians Vinka, Azawi, Sheebah Karungi, and Rema Namakula.

The show was history in the making as over 50,000 people were registered. Pictures and remarks lauding Winnie Nwagi were posted on social media. One of the eye-catching lauds came from Rema Namakula who vented that She was a big fan of Fire baby.

Talking to the media while on the show, the cease and sekkle singer uttered, “She is incredibly talented, and you can’t doubt it. I like her so much. I like her maverick attitude. She is real. She does not fake. When you abuse her, she returns the same vibe. I like her for not allowing anyone to bully her online”.

Winner Nwagi has been in the music industry for over 7 years and last Friday’s concert was the first of a kind. It was a success as expected because of the interesting and great music catalog she has created over the years.
