Justice Muhanguzi Bows Out, Replaced by Kwesiga

The Principal Judge Dr Yorokamu Bamwiine has assigned Justice Wilson Kwesiga, the current head of Criminal Division at High court as the new head of the panel of three International Crimes Division judges handling the Muslims Clerics trial, where Sheikh Yunus Kamoga and 13 others are facing terrorism, murder and attempted murder charges.

This follows the retirement of Judge Ezekiel Muhanguzi, who has been heading the panel, in February upon clocking the mandatory retirement age of 65.

His (Judge Muhanguzi) three-month extension to complete his pending work also ended on May 16, which automatically bars him from handling court cases unless he gets a contract.

However Judiciary’s request to have Justice Muhanguzi re appointed on contract is still pending before the Judicial Service Commission.

To that effect, the Principal Judge invoked Article 141 of the Constitution and Section 20 (1) of the Judicature Act to temporarily assign Justice Kwesiga on the ongoing matter.

“This is to assign you justice Wilson Kwesiga to head the Panel of Judges that will manage the case come 26th May 2017 and thereafter if need be, as the issue of his reappointment gets the necessary attention of the appointing authority,” wrote Justice Bamwiine in part in his May 15 letter.

The two other judges in the Muslims Clerics trial are Lady Justices: Percy Tuhaise and Jane Kiggundu. Justice Kwesiga late last year was appointed the head of High court criminal division replacing Justice Wilson Masalu Musene who was transferred to Mpigi High court.
